Terms of Use

These Terms of Use ("Terms") govern your access to and use of The Animesh (the "Site"). By creating an account or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility & accounts

You agree to provide accurate information, including a preferred name, and to keep your password confidential. You are responsible for activity under your account. Notify us promptly of any unauthorised use.

2. Roles and posting rights

By default, registered users may read content, react, and comment. The ability to publish blog posts ("writer access") is granted by an administrator and may be temporary (expiring at a set date/time) or permanent. If you are granted writer access, you may create, edit and delete your own posts and moderate the comments and reactions on them. Administrators retain full control over all content on the Site. Writer access may be modified or revoked at any time.

3. Your content and licence

You retain ownership of the content you create (posts, comments). By submitting content, you grant The Animesh a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and distribute that content for the purpose of operating and promoting the Site. You represent that you have the rights to the content you submit and that it does not infringe anyone else's rights.

4. Acceptable use & prohibited content

You agree not to post or transmit content that is, or to use the Site to:

contain adult, sexually explicit, obscene, hateful, harassing, defamatory, or violent material;
be unlawful, threatening, abusive, or that incites harm or discrimination;
infringe intellectual-property, privacy or other rights of others;
contain spam, malware, or attempts to gain unauthorised access;
impersonate any person or misrepresent your affiliation.

Submitted content is automatically screened for prohibited language before publication.

5. Moderation, suspension & termination

We may, at our discretion and without prior notice, edit, remove or refuse any content, and we may suspend (temporarily or permanently) or terminate accounts that violate these Terms. Where we suspend an account we will record a reason. You may delete your own account at any time from the Privacy & data page; doing so removes your account and associated content as described in the Privacy Policy.

6. Intellectual property

The Site's name, design, and software are owned by The Animesh or its licensors and are protected by law. These Terms do not grant you any right to use our trademarks or branding without permission. If you believe content on the Site infringes your copyright, contact us at xob23011@astra.xlri.ac.in with details and we will respond appropriately.

7. Third-party links

The Site may contain links to third-party websites. We are not responsible for their content, policies or practices. Following such links is at your own risk.

8. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. User-generated content reflects the views of its authors, not of The Animesh.

9. Limitation of liability

To the maximum extent permitted by law, The Animesh and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of (or inability to use) the Site or from any user content. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold harmless The Animesh from any claims, damages or expenses arising out of content you submit or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection or data-protection rights you have in your country of residence (including under the GDPR where applicable).
